How does the Indian Constitution protect fundamental rights

Explain the constitutional safeguards to ensure protection of fundamental rights in India.
The Indian Constitution safeguards fundamental rights through various provisions to ensure protection and promotion of these rights. Here are some of the Constitutional safeguards:
  • The Constitution provides for a comprehensive list of fundamental rights, which includes Right to Equality, Right to Freedom, Right against Exploitation, Right to Freedom of Religion, Cultural and Educational Rights and Right to Constitutional Remedies.
  • The Constitution has established an independent judiciary to interpret and enforce fundamental rights.
  • Any law inconsistent with the fundamental rights can be declared invalid by the Supreme Court or the High Court.
  • The Constitution empowers the Parliament to amend the Fundamental Rights provisions, but this power is subject to certain restrictions.
  • The Constitution recognizes the importance of socio-economic rights, such as the right to education and the right to work.
  • The Constitution has also established various constitutional bodies such as National Human Rights Commission, the National Commission for Scheduled Castes and Scheduled Tribes to safeguard and protect the rights of vulnerable and marginalized sections of the society.
These Constitutional safeguards ensure that the fundamental rights of Indian citizens are protected and promote the well-being and development of individuals and the society as a whole.
