The Uniform Civil Code (UCC) is a proposal to replace the personal laws of various religions with a single set of laws governing all citizens. The purpose of the UCC is to promote gender equality and to remove discrimination in personal laws based on religious beliefs. The Law Commission of India in 2018 submitted a report regarding UCC and gave certain suggestions. Some of the important suggestions are:
  • The government should take steps to include a provision in the Hindu Marriage Act for registration of marriage among Hindus, Buddhists, Jains, and Sikhs.
  • The government should also take steps for a common marriage registration system which can be utilised by all religious communities in the country.
  • There should be no discrimination in adoption laws on the basis of religion.
  • Proposed a new marriage law 'Marriage and Divorce Bill'. It is aimed at curbing arbitrary/oppressive practices currently inflicted on women.
The implications of UCC can be far-reaching as it will remove the present system of personal laws based on religion and replace it with a uniform law applicable to all citizens irrespective of their religion. This could potentially lead to resistance from different religious communities as they might view it as an attack on their religious identity. However, it could also promote gender equality and by removing discrimination from personal laws could pave the way for a more egalitarian society.
